You are responsible for any information you choose to provide and for ensuring that you have the necessary rights to submit it. You should notify us if you become aware of unauthorized account activity or a security problem affecting the Services. You are also responsible for maintaining a compatible device and any internet or mobile network connection needed to use the Application. Charges imposed by your mobile carrier or internet provider remain your responsibility.
Ownership of the Application and Its Content
The Application, including its software, source code, design, graphics, text, interfaces, trademarks, logos, and other original materials, belongs to the Company or its licensors. These materials are protected by applicable copyright, trademark, and other intellectual property laws. The license granted under this Agreement allows you to use the Application but does not transfer ownership of these materials. Unless we give written permission or the law allows otherwise, you may not reproduce, modify, distribute, publish, or commercially use protected Content. Any third-party names, logos, trademarks, or images appearing in the Services belong to their respective owners. Their appearance does not mean that the Company is affiliated with, sponsored by, or endorsed by those third parties unless expressly stated.
Content You Provide
Certain Application features may allow you to submit, upload, or process User Content. You retain ownership of any original material you lawfully own. By providing User Content, you give the Company permission to access, process, store, and transmit that material only as reasonably necessary to provide the feature you have requested, subject to the Privacy Policy and Applicable Law. You confirm that you have the necessary rights or permissions to submit the material. You must not use the Services to process or distribute material that violates Applicable Law or the rights of others. We may remove or restrict User Content where reasonably necessary to address a legal complaint, security concern, or violation of the Agreement.
Suggestions and Feedback
We welcome comments, ideas, and suggestions that may help improve the Application. If you voluntarily provide feedback, you allow the Company to review and use that feedback to improve or develop its Services. Unless a separate written agreement provides otherwise, we may use general suggestions or ideas without paying compensation. Providing feedback does not transfer ownership of unrelated material that you lawfully own. Any Personal Information included in your feedback will be handled in accordance with our Privacy Policy.
Updates and Changes to the Services
We may update the Application to introduce features, improve performance, address security issues, or comply with legal requirements. Some updates may be necessary for particular features to continue working. We may also modify, temporarily suspend, or discontinue parts of the Services for legitimate technical, security, legal, or business reasons. Where appropriate, we will provide notice of material changes. If changes affect Paid Features or rights arising from an existing purchase, we will follow the applicable purchase terms and consumer protection laws. We do not guarantee that every feature will remain available indefinitely.
Payments and Charges
The Application may offer certain features or Services that require payment. While some features may be available free of charge, the Company may introduce fees for additional features or access to the Services in the future. Any applicable charges will be communicated to you before making a purchase. Full payment of the stated amount is required to access the relevant Paid Features. The Company may revise its fees or introduce new charges from time to time, subject to Applicable Law
Third-Party Services and Links
The Application may use Third-Party Services to provide technical features, advertisements, payments, analytics, or other functionality. It may also include links that direct you to external websites or applications. These services are operated by independent organizations and may have their own terms and privacy policies. We do not control independent third-party content, business practices, or service availability. The inclusion of an external link or integration does not automatically mean that we endorse the relevant provider. Some external links may be affiliate links. Where applicable, the Company may receive compensation if a User visits, installs, or purchases a product or service through such a link. Any applicable affiliate relationship will be disclosed where required by law. Before using an external service or making a purchase through another provider, we recommend reviewing that provider's terms and privacy practices. The Company is not a party to separate agreements between Users and independent providers unless expressly stated. We are not responsible for independent third-party conduct beyond our own obligations under Applicable Law.
Third-Party Providers Used by the Application
The Application may use the following types of external providers.
Limits on Liability
To the extent allowed by Applicable Law, the Company, its affiliates, employees, representatives, and Service Providers shall not be held liable for any indirect, incidental, special, or consequential damages connected with the use of, or inability to use, the Services. This includes losses relating to data, profits, business opportunities, goodwill, or the cost of obtaining alternative services, whether arising from service interruptions, technical issues, third-party services, or other matters associated with the Application. These limitations apply regardless of whether a claim is based on contract, negligence, or any other legal grounds, even if the Company has been informed of the possibility of such losses. Nothing in this section excludes or restricts liability that cannot be limited under Applicable Law.
Responsibility for Claims
You agree to be responsible for losses or claims arising directly from your unlawful use of the Services or material breach of this Agreement.
To the extent permitted by Applicable Law, you agree to indemnify the Company and its relevant representatives against third-party claims and reasonable expenses resulting from:
- Intentional or unlawful misuse of the Services.
- Infringement of another person's intellectual property rights.
- Submitting or distributing User Content without the necessary authorization.
- Deliberately damaging or interfering with the Services.
- A material breach of the Agreement that causes a legally attributable loss.
This obligation does not require you to compensate the Company for losses caused by its own unlawful conduct or for matters where responsibility cannot legally be transferred.
Warranties and Service Availability
We make reasonable efforts to provide a reliable and functional Application. However, to the fullest extent permitted by Applicable Law, the Services are provided on an "as is" and "as available" basis. We do not promise that the Services will always be available, uninterrupted, error-free, or compatible with every device. We also cannot guarantee that every result, recommendation, or piece of information provided through the Application will be accurate, complete, or appropriate for every purpose. Certain functions may depend on third-party systems, internet connections, or device settings outside our control. Where permitted by law, we exclude implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Nothing in these Terms removes consumer guarantees or statutory rights that cannot legally be excluded.
Copyright Complaints
We respect the intellectual property rights of others.
If you believe that Content available through the Services infringes your copyright, you may send a written complaint to the Company.
The notice should contain:
- Your name and contact details.
- Identification of the copyrighted material.
- A description of the material you believe infringes your rights.
- Information sufficient for us to locate the disputed material.
- A statement that you believe the use is not authorized by the rights holder, its representative, or the law.
- A statement confirming that the information is accurate and that you are the copyright owner or authorized to act for the owner.
- Your physical or electronic signature.
Please send copyright complaints to support@sincereaffirmations.com.
Upon receiving a valid notice, we will review the complaint and take appropriate action, which may include removing or disabling access to the disputed material. Notices that do not meet the requirements of 17 U.S.C. § 512(c)(3) may not qualify as valid DMCA notices. Where applicable, affected parties may submit a counter-notification in accordance with the law.
Ending or Restricting Access
You may stop using the Application at any time. If an account is available, you may request account closure or use the account deletion options provided through the Services. We may suspend, restrict, or terminate access where a User materially violates the Agreement, engages in unlawful activity, or creates a significant security risk. We may also discontinue the Services for legitimate operational, legal, or business reasons. Where reasonably appropriate, we will provide notice or an opportunity to address a violation before terminating access. Termination does not remove payment obligations that lawfully arose before termination or affect rights that have already accrued. If an existing purchase is affected by termination or discontinuation, mandatory consumer protection rights will continue to apply.
Handling Disputes
If you have a concern about the Services or the Agreement, we encourage you to contact us before starting formal legal proceedings. We will make reasonable efforts to review the issue and attempt to reach a resolution. If the dispute cannot be resolved informally, either party may use the legal remedies available under Applicable Law.
Individual Claims and Class Actions
To the extent permitted by Applicable Law, you and the Company agree to bring claims individually rather than as members of a class, collective, or representative proceeding. This restriction does not apply where such rights cannot legally be waived. If the class action waiver is found unenforceable, the remaining terms will continue to apply to the extent permitted by law.
Circumstances Outside Our Control
The Company may be unable to provide some or all of the Services during events beyond its reasonable control. These events may include natural disasters, major network failures, infrastructure outages, war, government restrictions, labor disruptions, or other extraordinary circumstances. We will take reasonable steps to address the disruption when practical. The Company will not be responsible for delays or failures directly caused by such circumstances to the extent permitted by Applicable Law. This section does not remove any non-waivable legal responsibilities.
Arbitration
Where expressly agreed and legally permitted, certain disputes may be resolved through binding arbitration instead of court proceedings. Any binding arbitration arrangement must identify the arbitration rules, administrator, location or remote hearing options, fees, applicable exceptions, and any available right to reject arbitration. Unless those details are provided in a properly adopted arbitration agreement, these Terms do not require mandatory arbitration.
Governing Law and Courts
This Agreement is governed by the laws of the State of California, United States, without applying rules that would otherwise select the laws of another jurisdiction, except where mandatory law requires otherwise. Subject to legally protected consumer rights, court proceedings relating to the Agreement will be brought before the appropriate courts located in the State of California, United States. Nothing in this section prevents a User from exercising mandatory rights or remedies available under the laws of their country or state of residence.
Changes to These Terms
We may revise these Terms from time to time to reflect changes in our Services, business practices, or legal requirements. We encourage you to review this page regularly to stay informed about any updates to these Terms.
General Conditions
If any part of this Agreement is found to be invalid or unenforceable, the remaining provisions will continue to apply. The Company's decision not to enforce a particular provision at any time does not prevent it from doing so in the future.
You may not transfer your rights or responsibilities under this Agreement to another person or entity without our written approval. However, we may transfer our rights and obligations in connection with a merger, acquisition, business restructuring, or sale of assets, where permitted by Applicable Law.
The Agreement, including these Terms, the Privacy Policy, and any additional terms incorporated into them, represents the complete understanding between you and the Company regarding the Services and replaces any previous agreements concerning the same subject matter, unless otherwise specified.
Nothing in this Agreement creates a partnership, employment, agency, or joint venture relationship between you and the Company. Unless expressly stated or required by law, no other person or organization has the right to enforce its provisions.
We may communicate important information about the Services electronically, including through the Application, our website, or the contact details you provide, where permitted by Applicable Law.
Certain provisions will remain effective after you stop using the Services, including those concerning intellectual property, outstanding payments, liability, dispute resolution, and obligations arising before termination.
